1. Acceptance of Terms

By accessing and using the Street Burger online ordering platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform.

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law Street Burger and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Street Burger liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

2. Use of the Platform

2.1 You must be at least 18 years old to use this Platform.

2.2 You agree to provide accurate, current, and complete information when creating an account or placing an order.

2.3 You are responsible for maintaining the confidentiality of your account information and password.

2.4 Access to this platform is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.

3. Ordering and Payment

3.1 All prices listed on the Platform are in local currency (LKR) and are subject to change without notice.

3.2 By placing an order, you agree to pay the full amount for the items ordered, including any applicable taxes and delivery fees.

3.3 We accept Credit and Debit cards payment. Payment is processed securely through Commercial Bank payment gateway.

3.4 While processing your order our payment gateway carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorization being received. Disclaimer of Liability

4. Pickup

4.1 Platform only accepts pickup orders.

4.2 For pickup orders, please arrive at the branch at selected pickup time. Orders not collected within 1.5 hours may be discarded, and refunds will not be issued.

4.3 Estimated pickup times are provided but not guaranteed.

5. Cancellations and Refunds

5.1 Orders cannot be cancelled after placing the order via the online platform.

5.2 Refunds will be issued at our discretion for valid complaints about food quality or order accuracy.

6. Allergen Information

6.1 We cannot guarantee that our food is free from allergens due to the nature of our kitchen operations and may contain Nuts, Dairy, Gluten, Egg etc..

6.2 It is the customer's responsibility to check allergen information before placing a order.

7. Intellectual Property

All content on this Platform, including but not limited to text, graphics, logos, and software, is the property of Street Burger and is protected by copyright laws.

8. Limitation of Liability

Street Burger shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform or our services.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.

11. Indemnity

You agree to indemnify, defend and hold harmless Street Burger, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this Website or your breach of the Terms of Service.
